Technically they don't have the rights to it as they didn't create that piece so they don't own it. They could say that the creator did not have rights to make that derivative but once it's done I'm fairly certain they can't just say its ours. Unless I'm mistaken, that was both a commercial album and collaboration with Capcom. They likely have the right to use any song from that album as they see fit. Don't quote me on that, though. This has already been answered, but yeah, it's their album, and they do own it. I'm a remixer on the album and I had to sign a form about it. Basically, without all the legal speak, I signed away my derivative work rights to OCR. I assume then OCR, with all the derivative work rights to every track, signed them away to Capcom. Capcom now had all rights to the music. Then, Capcom (generously) gave licensing rights to OCR, and then the album was sold on iTunes and such. Brett from Capcom-Unity emailed us and let us know they were using the MM25 track in the announcement trailer months ago when they were first announcing this game.
