If BS be callin' it tasteless, and be right, that really be saying something. Great talent lost; Game Arts was truly badass. -

As a side note, when Larry & I were judging the IGF awards, I turned some folk onto Jamestown regarding its score. Not enough to beat out the likes of Amnesia or Bastion or Retro City Rampage, maybe, but I put my two cents in - good stuff, needs a mix!

*NO* Scurge: Hive 'The Desert Scourge'
djpretzel replied to DragonAvenger's topic in Judges Decisions
HUG IT OUT, BROS Just chiming in on the substantive point: Larry's statement that the obscurity of the source should not influence the evaluation is accurate, based on our standards. -
It's absolutely worth mentioning - the site he links to there is http://www.boutell.com/newfaq/creating/licensecovers.html, which says: OKAY MR. WEBPAGE! But wait... what about parody? Satire? What about non-commercial, transformative work that also serves an educational purpose? Do ASCAP/BMI/etc. really have the legal ability to completely moot ANY and ALL arguments of Fair Use??No. They do not. They DO have some very big legal guns, though... but apparently, so do some photographers... THIS would have been the more meaningful place to make a Fair Use argument, w/ regards to the actual music. Instead, he licensed the music, and did nothing with the cover, then claimed Fair Use when issues arose. For all of Jack's extended pontifications and "alternative" views on copyright law at large, Jack's right about one thing: A lot of smart people seem to get confused about Fair Use. So, in other words, he definitely could have given it away for free, but he would have been at risk of having to make Fair Use claims about the music, too.
